Steps in the Litigation Process

Ohio Medical Malpractice Lawsuit

The Donahey Law Firm understands that personal injury cases can be a very long and difficult process from the time the lawsuit is filed until any settlement is reached due to the other individual’s insurance company, or the person responsible for your injury not having an obligation to settle in a timely manner. To help speed up the litigation process it is important to contact an attorney to make court preparations and to have all documentation needed for the trial in order. Medical malpractice litigation in Ohio can consist of six steps:

  • "Paper" Discovery
  • Deposition
  • Motion Hearings
  • Mediation / Arbitration
  • Trial
  • Collectio

The deposition consists of questions under oath asked by the insurance company’s lawyer. The questions are in extensive detail concerning your personal background, the injury, the accident, and treatment received.

Counsel for the insurance company has the capability to file numerous motions during the medical malpractice lawsuit and hold hearings with respect to the motions filed.

Mediation is a non-binding settlement conference, unless an agreement is reached and written up, outside of court in which both parties try to reach a middle ground before the actual trial begins.

If the medical malpractice lawsuit in Ohio is not settled during mediation, the parties will go to trial in which a jury will decide the verdict of what the injury is worth. When a trial is concluded, it does not mean the case will be over because of appeals and other motions and hearings.

After a settlement or verdict is reached, collection from the insurance companies or person responsible for the injury can be difficult. With the proper counsel representation, this process can move swiftly.

If you or a family member has been injured and needs respectable representation, contact the Ohio medical malpractice lawyers of The Donahey Law Firm for a free consultation by email at help@donaheylaw.com, or call us anytime at 1-800-686-1699. Let us fight for you.
